General Terms & Conditions
1. GENERAL
1.1. Cycling Sports Group Europe B.V., Geeresteinselaan 57, 3931 JB Woudenberg, The Netherlands (the "Organizer") organizes a promotional game of chance in order to promote the Cannondale brand. An eligible participant ("Participant") has the chance to win various prizes by completing the online entry form (the "Action").
1.2. These General Terms and Conditions (the "Terms") are provided to potential Participants prior to their participation in the Action. By participating the Participant thereby unconditionally confirms to have read and to accept these Terms, without any reservation or limitation, and the Participant declares to be bound by these Terms. 2. THE ACTION
2.1. To participate in the Action and to be eligible for the prize(s), the Participant must visit https://www.cannondale.com/fr-fr/giveaways/swag-bag-rules during the Action and complete the online entry form, including first and last name and valid email address.
2.2. No entry fee applies to participating in the Action.
2.3. The starting date of the Action is 1 November 2021 at 00:00 CET and the closing date of the Action is 28 February 2022 at 23:59 CET and consists of four (4) monthly entry periods (each, a “Monthly Entry Period”). Each Monthly Entry Period begins on the first day of each calendar month and ends on the last day of the same calendar month as outlined below:

3. PARTICIPANTS
3.1. The Participant must be a legal resident of France and be at least 18 years old and have reached the age of majority in their jurisdiction of residence. Void outside France and where prohibited by law.
3.2. Excluded from participation are:
3.2.1. permanent and temporary employees of the Organizer, its subsidiaries, and affiliates;
3.2.2. permanent and temporary employees of third parties who assist the Organizer in the organization of the Action; and
3.2.3. first-line family members of the employees referred to under 3.2.1 and 3.2.2.
3.3. The Organizer is entitled to exclude the Participant from (further) participation in the Action in case the entry appears to be fraudulent, in case the entry is possibly unlawfully influenced or in case the Participant has violated these Terms.
3.4. Participants are allowed to participate once. This means that multiple entries of one Participant will automatically be deleted and that the Participant will be excluded from participation in case of any attempt of multiple entries.
3.5. The Participant guarantees to provide the Organizer with all necessary accurate and correct (personal) data in the context of the Action.
4. WINNERS
4.1. A total of one (1) winner(s) will be selected at random from all Participants that have submitted an eligible entry during each Monthly Entry Period, for a total of four (4) winners during the entire Action. The selection of the winner(s) of the prize(s) takes place in an impartial manner. Non-winning entries will be automatically included in subsequent Monthly Entry Period drawings.
4.2. The results of the Action will be announced within three months after the end of the Action. The winner(s) will be notified on or about the dates indicated under 2.4 by the Organizer by email about when and where the prize will be delivered. If the winner cannot be contacted within two (2) days after the notification of the Organizer, the Organizer reserves the right to withdraw the winner and the Organizer will randomly pick a replacement winner.
4.3. Participants may request the Organizer to provide an overview of the prizes that have been awarded by the Organizer in the context of this Action.
5. PRIZES
5.1. The first prize (one (1) prize(s) available) includes one (1) Cannondale t-shirt (estimated value of € 24,4) and one (1) Cannondale beanie hat (estimated value of € 25,5). The prize has a total estimated value of € 49,9 (VAT included). A total of one (1) prize will be awarded for each Monthly Entry Period, for a total of four (4) prizes awarded for the entire Action. Total estimated value of all prizes, € 199,6.
5.2. The prize(s) is/are as stated above and no cash or other alternatives will be offered to the winner(s). The prizes are not transferable. Prizes are subject to availability and the Organizer reserves the right to substitute any prize with another prize of equivalent economic value without giving prior notice.
6. RESPONSIBILITY AND LIABILITY
6.1. The Participation in the Action is at the own risk of the Participant.
6.2. To the fullest extent permitted under applicable law, the Organizer is not liable for any direct and/or indirect damages suffered by a Participant in connection with or resulting from their participation in the Action or in the context of winning the prizes.
6.3. The Organizer is not liable for (i) entries that for any reason have not been received by the Organizer, (ii) malfunctions in IT systems that result in limited, delayed or loss of entries, (iii) damage suffered by any Participant as a result of typing errors, or (iv) inaccurate prize details supplied to any Participant by any third party connected to this Action.
7. PRIVACY
7.1. The Organizer shall process the personal data provided in the context of the Action in accordance with its privacy statement: http://www.dorelsports.com/privacy-policy/.
8. COMPLAINTS
8.1. If the Participant has any questions, comments and/or complaints about the Action the Participant can contact [email protected].
8.2. The Organizer will respond to any request as quickly as reasonably possible.
9. GAMBLING TAX
9.1. If any gambling tax applies to any of the prize as set out above, such costs shall be borne entirely by the Organizer.
10. FINAL REMARKS
10.1. The Organizers decisions concerning the Action are final.
10.2. If any provision in these Terms is invalid or unenforceable, the Organizer will replace such provision with a provision that aligns with the purpose and scope of the invalid or unenforceable provision as closely as possible.
10.3. The Organizer shall at any time have the right to change or modify the Terms, provided that no change disadvantages a Participant. The Organizer shall inform the Participant prior to such changes becoming effective where such notification is required under applicable law. If the Participant does not accept such changes, it has the right to terminate its participation in the Action.
10.4. The Organizer may cancel the Action or amend the Terms without prior notice if an event outside its control occurs that stops, or substantially limits, it from running the Action as planned, or if running the Action would or may put it in breach of applicable laws or regulations.
