CANNONDALE PRIVACY POLICY

CYCLING SPORTS GROUP is sensitive to privacy issues on the Internet. We believe that it is important you know how we treat the information about you that we receive via the Site.

In general, you may visit the Site without telling us who you are or revealing any personally identifiable information about you. Our servers capture, but do not collect, the IP addresses, domain names and network identifiers of our users. This information is aggregated to measure the number of visits, average time spent on the Site, pages viewed, etc. CYCLING SPORTS GROUP uses this information to measure the use of our Site and to improve the content of our Site. E-mail addresses and other personally identifiable information such as first and last name, home or other physical address, telephone number and other similar information are known only when voluntarily provided by a visitor for registration of product purchase, sweepstakes, contests or other participation of visitors in any available online interactive activities.

Unless otherwise disclosed during the collection, personally identifiable information that may be collected in connection with visitors to this Site is retained by CYCLING SPORTS GROUP or subsidiary corporations ("Affiliates"). CYCLING SPORTS GROUP and our Affiliates do not sell, transfer or otherwise disclose this personally identifiable information outside those companies, except where disclosure is required by law.

We may use the personal information you provide for any of the following purposes: To contact product owners (1) in response to product recall, (2) to understand the use of our Site and make improvements; (3) to fulfill prizes; (4) to respond to specific requests from visitors; (5) to obtain parental consent from visitors under 18 years of age, where necessary; (6) to provide any necessary notices to our visitors or their parent or guardians, where necessary; (7) to protect the security or integrity of our Site when necessary; (8) to send you notices and solicitations regarding Site and our businesses; (9) share with authorized Cannondale retailers to promote and (10) in general to promote and market our products to you. These solicitations may take the form of mailings via U.S. mail or other couriers, telephone calls, e-mail solicitations and other methods of contact. It is our policy that visitors to our Site who are under the age of 18 should not post on or provide information to our Site without the consent of their parents. You should supervise the online activities of your children, and consider the use of parental control tools available from online services and software providers that help provide a kid-friendly Internet environment.

A technology called "cookies" may be used to provide you with tailored information. A "cookie" is a tiny element of data that a Web site can send to your browser, which may then be stored on your hard drive so we can recognize you when you return. You may be able to set your browser to notify you when you receive a cookie. Our cookies collect the operating system and browser that a visitor is using.

This Site has security measures in place to protect against the loss, misuse and alteration of the information under our control. When credit card information is transmitted we use industry standard, SSL (secure socket layer) encryption.

We may revise this Privacy Policy from time to time. You are responsible for checking this policy when you visit our Site to review the current policy. If you do not agree with the policy, you should cease use of the Site immediately.

CANNONDALE LIMITED WARRANTY

The specific warranty covering your Cannondale bicycle is governed by the law of the state or country in which it was purchased, and applies only to bicycles purchased from Authorized Cannondale Retailers.

 

FRAMES (frame, fork structure, swing arm):

 

Cannondale frames (except frames for Freeride, and Dirt Jumping bikes, see below) are warranted by Cannondale Bicycle Corporation, 16 Trowbridge Drive, Bethel, CT 06801 against manufacturing defects in materials and/or workmanship for the lifetime of the original owner.

Cannondale frames for Freeride & Dirt Jumping bikes (such as Gemini, Gemini DH, Judge, Perp and Chase) are warranted against manufacturing defects in materials and/or workmanship for a period of three (3) years from the date of original retail purchase. The Freeride / Dirt Jumping warranty does not cover any Freeride / Dirt Jumping bike purchased and used for rental purchase. The Freeride / Dirt Jumping warranty differs from the warranty as stated in the Cannondale Owner's Manual only in its term. All other conditions apply.

 

COMPONENTS:

 

All other components, including HeadShok and Lefty internal parts, suspension parts, frame fixtures and finishes (paint and decals) are warranted against manufacturing defects in materials and/or workmanship for a period of one year from the date of original retail purchase. Components used on rental fleet bikes are not covered by this one year warranty. Suspension forks (other than those made by Cannondale) are not covered by this limited warranty, but are separately covered by the stated warranty of their manufacturer.

 

TERMS OF LIMITED WARRANTY:

 

This limited warranty is not meant to suggest or imply that the bicycle cannot be broken or will last forever. It does mean that the bicycle is covered subject to the terms of the limited warranty.

This limited warranty applies only to the original owner of a Cannondale bicycle and is not transferable to subsequent owners.

For any warranty claim to be considered, the bicycle must be brought in to an Authorized Cannondale Bicycle Retailer on the same continent on which the bicycle was purchased. The bicycle must be in assembled condition and accompanied by the original, dated sales receipt for the bicycle. (Be sure to keep your receipt in a safe place.)

This limited warranty is void if the bicycle is subjected to abuse, neglect, improper repair, improper maintenance, alteration, modification, an accident or other abnormal, excessive, or improper use.

This limited warranty applies only to bicycles purchased in fully assembled and adjusted condition from Authorized Cannondale Retailers or other outlets specifically authorized by Cannondale to distribute Cannondale bicycles. Certain Cannondale retailers in the US are specifically authorized by Cannondale to sell only triathlon specific bicycles directly to customers in the US.

Damage resulting from normal wear and tear, including the results of fatigue, is not covered. Fatigue damage is a symptom of the frame being worn out through normal use. It is one kind of normal wear and tear, and it is the owner's responsibility to inspect his/her bicycle.

Damage resulting from improper assembly or maintenance, or from installation of parts and accessories not compatible with the Cannondale bicycle, is not covered.

All labor charges for warranty service, including the transfer of components and/or any installation of new components, are the responsibility of the bicycle's owner. Due to product evolution and obsolescence, some components may not be available for older models. In these cases, sourcing and paying for components is the responsibility of the bicycles owner.

During the duration of this limited warranty, Cannondale will either repair any defective frame or component, or, at our option, replace any defective frame or component with the same or most nearly comparable model or component then available. THIS IS THE EXCLUSIVE REMEDY UNDER THIS WARRANTY. ANY AND ALL OTHER REMEDIES AND DAMAGES THAT MAY OTHERWISE BE APPLICABLE ARE EXCLUDED, INCLUDING, BUT NOT LIMITED TO, INCIDENTAL OR CONSEQUENTIAL DAMAGES OR PUNITIVE DAMAGES.

THIS IS THE ONLY WARRANTY MADE BY CANNONDALE ON ITS FRAMES AND COMPONENTS, AND THERE ARE NO WARRANTIES WHICH EXTEND BEYOND THE DESCRIPTION HEREIN. ANY WARRANTIES THAT MAY OTHERWISE BE IMPLIED BY LAW INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE EXCLUDED.

Please refer to the documents included with your bicycle for possible further restrictions.

This Limited Warranty gives the consumer specific legal rights. The consumer may also have other legal rights which vary from state to state or country to country. Some states and countries do not allow the exclusion or limitation of incidental or consequential damages or warranties, so the above limitations or exclusions may not apply to you. If it is determined by a court of competent jurisdiction that a certain provision of this limited warranty does not apply, such determination shall not affect any other provision of this limited warranty and all other provisions shall remain in effect.

WARNING RE. BICYCLE WEB SALES:

Cannondale bicycles are intended to be sold only in a completely assembled and adjusted condition, by authorized Cannondale Retailers at authorized locations. We have generally prohibited the sale of Cannondale bicycles through the Internet or mail order. The sole exception is a US retailer specifically authorized by Cannondale to sell only triathlon specific bicycles directly to customers in the US. If you have any suspicion or concerns re the authenticity of a seller, please call us at 1-800-BIKE-USA.

We do this for your safety. Taking the professional retailer out of the process increases the chance of assembly errors that could lead to an accident or injury. Proper assembly and adjustment are key aspects of maximizing safety, and Cannondale requires the retailer to completely assemble and adjust every Cannondale bicycle prior to its sale. This is particularly important with the unique and innovative features specific to many Cannondale bicycles. We also require that the retailer orient you to the particular bicycle, and to review safety equipment. Please note that your initial 30 day service visit is also very important. Beyond safety, your fit, comfort and satisfaction with the performance of the bicycle are best assured by hands-on professional service.

Finally, as authorized Cannondale retailers are not permitted to sell our bikes via the Internet or mail order, those bikes that are offered through these channels are often second hand, counterfit/fake, or compromised in some way. Be aware that internet fraud happens. We have seen very professional looking websites with illegally obtained images of our bikes that are a complete fake! We have talked to people who have been tricked into thinking they were dealing with a legitimate company and have lost their money. Please don't let this happen to you.

In addition to the risks described above, with one exception, purchasing a Cannondale bicycle via the internet voids all product warranties. A Cannondale triathlon specific bicycle purchased from a US retailer specifically authorized by Cannondale to sell only triathlon specific bicycles directly to customers in the US is subject to the standard Cannondale Limited Warranty. Save yourself a headache and support your local authorized Cannondale bicycle retailer.

INTERNET PRICING POLICY

Cannondale sells products in countries around the world, all with different currencies, duties and taxes. Cannondale selects components from around the world, and the prices of those components fluctuate. Please contact your retailer for pricing.

INTERNET WEIGHT POLICY

Please note that weights may vary, due to many variables, such as frame size, components included or excluded as well as running changes to component specifications. We urge you to weigh the bikes or frames you are considering, at your retailer,with identical or comparable equipment. There is no industry standard as to how a bicycle should be weighed. Think about the possibility that a competitor may be listing the weight of a 53cm bicycle without U.S. CPSC required equipment and without pedals... One good place to see a neutral evaluation of frame weight and frame life is at the EFBe website.
